Terms of Service
These terms apply to your use of this website. By browsing the site or contacting us through it, you agree to them. If you do not agree, please do not use the site.
Who these terms are with
This website is operated by Praetura Infrastructure and Developments Ltd., trading as Praetura, of 23-1501 Lonsdale Avenue, North Vancouver, BC V7M 2J2, Canada. "We", "us", and "our" mean that company; "you" means the person using the site.
Using this website
You may use this site for your own lawful, personal or business purposes. You must be at least 13 years old to use it.
You agree not to:
- Use the site in any way that breaks the law or infringes anyone's rights.
- Attempt to gain unauthorised access to the site, the server it is hosted on, or any connected system.
- Introduce viruses, malware, or any other harmful code, or overload the site with automated requests.
- Copy, scrape, or reuse the site's content or images other than as these terms allow.
- Use the contact details on the site to send unsolicited marketing or spam.
Our content
The text, photographs, logo, and design of this site are owned by Praetura Infrastructure and Developments Ltd. or used with permission, and are protected by copyright and trademark law. The Praetura name and helmet mark are our trademarks.
You may view the site and print or save pages for your own reference. You may not reproduce, distribute, or modify our content, or use our name or logo, without our written permission.
The logos of the industry associations shown in the footer belong to those associations and are shown to indicate our membership only.
Accuracy of information
We try to keep the information on this site accurate and current, but it is general information about our services and is provided "as is". Descriptions of our capabilities, equipment, and past work are illustrative; scope, availability, and site conditions vary from project to project. Nothing on this site is engineering, legal, or other professional advice.
Enquiries, quotes, and contracts
Nothing on this site is a binding offer to carry out work. A contract between us is formed only when we issue a written quote, tender, or agreement and you accept it in writing. Quotes are based on the information available at the time and may change if site conditions, drawings, or scope change.
Statements on this site about being licensed and insured describe our business generally; the licensing and insurance that apply to a particular project are set out in that project's contract documents.
Availability of the site
We aim to keep the site available at all times but do not guarantee that it will be uninterrupted or error-free. We may change, suspend, or withdraw any part of it without notice.
Third-party links and services
The site may link to websites we do not control, including the industry associations we belong to. We are not responsible for their content, accuracy, or terms, and a link does not mean we endorse them.
Our liability
To the fullest extent permitted by law, we exclude all implied warranties and conditions relating to this site and its content, and we are not liable for any loss or damage arising from your use of, or inability to use, the site, including indirect or consequential loss and loss of business, profits, or data.
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited or excluded by law. Nothing in these terms affects your statutory rights as a consumer.
The work we carry out on a project is governed by that project's contract, not by these website terms.
Your responsibility
If your misuse of this site in breach of these terms causes us loss (for example a claim from a third party, or the cost of restoring the site after an attack), you agree to compensate us for that loss to the extent it was caused by your breach.
Privacy
How we handle personal information is set out in our Privacy Policy, which forms part of these terms.
Changes to these terms
We may update these terms from time to time. The date at the top of the page shows when they were last revised. Continuing to use the site after a change means you accept the updated terms.
Governing law and disputes
These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. Any dispute about this site will be dealt with by the courts of British Columbia sitting in Vancouver, and you and we agree to their jurisdiction. If you are a consumer, this does not take away any right you have to bring a claim in your own province or to rely on the consumer-protection law that applies to you.
General
If any part of these terms is found unenforceable, the rest continues to apply. Our not enforcing a term is not a waiver of it. These terms, together with our Privacy Policy, are the whole agreement between us about your use of this site; any project work is covered by its own written contract.
